Electronic communications: common regulatory framework for networks and services. Framework Directive

PURPOSE : directive to establish a harmonised regulatory framework for electronic communications networks and services across the European Union.
CONTENT : this is one of six proposals that together create a new framework for the regulation of electronic communications networks and services. This directive seeks to respond to the convergence phenomenon by covering all electronic communications networks and services within its scope. It sets out a number of principles and objectives for regulators (National Regulatory Authorities) to follow, as well as certain procedures to which they are subject such as consultation and publication of information. It establishes a series of tasks in respect of management of scarce resources such as radio spectrum and numbering. In particular, NRAs are required to manage spectrum efficiently and have a right to permit the trading of frequency assignments, subject to certain safeguards. It also contains a number of horizontal provisions common to more than one measure in the package. These include the definitions of significant market power, the procedure to be used for market analysis, harmonisation measures, as well as provisions for the resolution of disputes between undertakings.�
