Community system of protection of plant variety rights: procedures for appeal before Community courts

The Commission proposal, concerning the amendment of Regulation (EC) 2100/94 establishing a Community system for the protection of plant variety rights, aimed to clarify the provisions relating to the procedures for appeal before Community courts in the different areas of industrial and commercial property rights. To this end, it was proposed that the rules applicable to appeals which could be made against the decisions of the Community Plant Varieties Office, or of its Boards of Appeal which had been instituted by the basic regulation, be aligned with those which had already been adopted in comparable fields by Regulation (EC) No 40/94 on the Community trade mark. This alignment should be completed before 27 April 1995, the date on which the new Community system would apply in full. �
