Hague Convention (2007) on the international recovery of child support and other forms of family maintenance: amending Annexes 1, II and III

PURPOSE: to amend Annexes II and III of Council Decision of 9 June 2011 on the approval, on behalf of the European Union, of The Hague Convention of 23 November 2007 on the International Recovery of Child Support and Other Forms of Family Maintenance.

LEGISLATIVE ACT: Decision 2014/218/EU of the Council amending Annexes I, II and III to Decision 2011/432/EU on the approval, on behalf of the European Union, of the Hague Convention of 23 November 2007 on the International Recovery of Child Support and Other Forms of Family Maintenance.

BACKGROUND: the Council adopted Council Decision 2011/432/EU on the approval, on behalf of the European Union, of The Hague Convention of 2007 on maintenance obligations. The Council Decision provides that the Union makes the reservations and declarations referred to in the Convention when depositing the instrument of approval of the Convention.

Annex II of Decision 2011/432/EU indicates the reservation to be made by the Union at the time of the approval of the Convention in line with Article 62 of the Convention.

Annexe III of the same Decision indicates the declarations to be made by the Union at the time of the approval of the Convention in line with Article 63 of the Convention.

After the adoption of the Decision in question, some Member states considered that it was necessary to amend their previous declaration (Latvia) or to reformulate their reserve and their declarations under the Council decision (Cyprus, Luxembourg and Portugal). Annexes II and III should therefore be amended before the deposit of the instruments of approval.

CONTENT: with the present Decision, Annexes II and III of Decision 2011/432/UE are replaced by the new corresponding Annexes annexed to the Decision.

Territorial provisions: the United Kingdom and Ireland participate in the adoption and application of this Decision.

Denmark is not participating in this Decision and is not bound by it nor subject to its application.

ENTRY INTO FORCE: the Decision enters into force on the 09.04.2014.
