European small claims procedure: replacing Annexes I,II, III and IV
The European Parliament has decided not to object to the Commission's delegated Regulation of 19 June 2017 replacing Annexes I, II, III and IV to Regulation (EC) No 861/2007 of the European Parliament and of the Council establishing a European small claims procedure.
No objections were raised within the period laid down in the third and fourth indents of Rule 105(6) of its Rules of Procedure, which expired on 4 July 2017.
Members recalled that the annexes to Regulation (EC) No 861/2007 set out the forms to be used to facilitate its application.
Regulation (EC) No 861/2007 was amended by Regulation (EU) 2015/2421, which will apply from 14 July 2017. The changes made to the European Small Claims Procedure should therefore be reflected in the forms set out in the Annexes to Regulation (EC) No 861/2007.
The new Annexes I to IV should apply at the same time as Regulation (EU) 2015/2421 and the delegated regulation should therefore enter into force on 14 July 2017.
