Aviation safety with regard to the withdrawal of the United Kingdom from the Union
PURPOSE: to continue to ensure a high level of air safety in EU airspace in the event that the United Kingdom leaves the EU without a negotiated agreement.
LEGISLATIVE ACT: Regulation (EU) 2019/494 of the European Parliament and of the Council on certain aspects of aviation safety with regard to the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the Union.
CONTENT: the Regulation establishes a mechanism to temporarily extend (for 9 months from the date of application of the Regulation) the validity of certain aviation safety certificates in the absence of a withdrawal agreement from the United Kingdom from the Union in order to allow sufficient time to issue the necessary certificates under Regulation (EU) 2018/1139 to take account of the United Kingdom's status as a third country.
The Commission may extend the period of validity of licences by means of delegated acts.
The Regulation concerns aviation safety certificates for certain aeronautical products, parts and appliances issued to natural and legal persons having their principal place of business in the United Kingdom and certificates issued by providers of aviation training services which are valid on the day before the date of application of the Regulation.
As regards the training of pilots and mechanics, the competent authorities of the Member States or the Agency, as applicable, shall take account of the examinations taken in training organisations that are subject to oversight by the competent authority of the United Kingdom but which have not yet led to the issuance of the license prior to the date of application, as if they had been taken with a training organisation subject to the oversight of the competent authority of a Member State.
ENTRY INTO FORCE: 28.3.2019. The Regulation shall apply from the day following that on which the Treaties cease to apply in the United Kingdom pursuant to Article 50(3) of the Treaty on European Union. Some provisions are applicable from the date of entry into force of the Regulation.
