EU/Chile Agreement: modification of concessions on all the tariff rate quotas included in the EU Schedule CLXXV as a consequence of the United Kingdom's withdrawal from the European Union

PURPOSE: to conclude, on behalf of the Union, the Agreement between the European Union and the Republic of Chile pursuant to Article XXVIII of the General Agreement on Tariffs and Trade (GATT) 1994 relating to the modification of concessions on all the tariff rate quotas included in the EU Schedule CLXXV as a consequence of the United Kingdom’s withdrawal from the European Union.

PROPOSED ACT: Council Decision.

ROLE OF THE EUROPEAN PARLIAMENT: Council may adopt the act only if Parliament has given its consent to the act. 

BACKGROUND: on 15 June 2018, the Council authorised the Commission to open negotiations pursuant to Article XXVIII of the General Agreement on Tariffs and Trade (GATT) 1994 on the apportionment of the tariff rate quotas included in the EU Schedule CLXXV as a consequence of the United Kingdom’s withdrawal from the Union.

Negotiations with the Republic of Chile have been concluded and the Agreement between the European Union and the Republic of Chile pursuant to Article XXVIII of the General Agreement on Tariffs and Trade (GATT) 1994 relating to the modification of concessions on all the tariff rate quotas included in the EU Schedule CLXXV as a consequence of the United Kingdom’s withdrawal from the European Union was initialled on 1 December 2022.

The Agreement was signed on behalf of the Union subject to its conclusion at a later date. The Agreement should be approved.

CONTENT: the draft Council Decision concerns the approval, on behalf of the Union, of the Agreement between the European Union and the Republic of Chile under Article XXVIII of the General Agreement on Tariffs and Trade (GATT) 1994 relating to the modification of concessions with respect to all tariff quotas in EU Schedule CLXXV following the withdrawal of the United Kingdom from the European Union.

The purpose of the agreement is to agree on the modification of concessions as notified to WTO Members and the resulting quantitative commitments on the part of the EU, which no longer includes the UK, in respect of tariff quotas for which Chile has negotiating rights under Article XXVIII of the GATT 1994.

In respect of the tariff quotas for which Chile has negotiating rights under Article XXVIII of the GATT 1994, Chile accepts the proposed quantitative tariff quota commitments as set out in document G/SECRET/42/Add.2 made by the Union following the withdrawal of the United Kingdom.

As regards tariff quota 020 (meat of sheep and goats, fresh, chilled or frozen), Chile and the Union agree to modify the commitments as follows: the volume for the Union of this specific Chilean quota is adjusted to 2527 tonnes.
