Request for the waiver of the immunity of Grzegorz Braun
The European Parliament decided to waive the immunity of Grzegorz Braun.
Poland's Prosecutor General requested the lifting of Grzegorz Braun's parliamentary immunity for several offences committed in 2022 and 2023, when he was not a Member of the European Parliament.
Grzegorz Braun is alleged to have, inter alia: (i) violated the physical integrity of a public official acting in his capacity as director of the National Institute of Cardiology; (ii) insulted the director of the National Institute of Cardiology, which could have harmed the public reputation of the official; (iii) damaged a Christmas tree and destroyed decorations that were the property of two Polish associations whose offices were located on the premises of the Krakow Regional Court; (iv) damaged property belonging to the German Historical Institute in Warsaw; (v) publicly insulted a group of people because of their religious affiliation and desecrated a religious object (a menorah) by extinguishing its burning candles with a fire extinguisher; and (vi) caused minor damage to a victim who intervened to protect public order. The Polish Sejm authorised the prosecution in January 2024.
Parliament considered that the alleged offences do not concern an opinion expressed or a vote cast in the exercise of the duties of a Member of the European Parliament. Furthermore, it has found no evidence to suggest that the legal proceedings in question were initiated with the intention of harming the political activity of a Member of the European Parliament and, therefore, of the European Parliament.
