Request for the waiver of the immunity of Grzegorz Braun
The European Parliament decided to waive Grzegorz Braun's immunity.
- On 2 June 2025, the Prosecutor General of Poland transmitted a request for the waiver of the immunity of Grzegorz Braun, Member of the European Parliament, in connection with several alleged offences that occurred in 2025 and in 2023.
- On 16 April 2025, on the premises of the District Hospital in Oleśnica, Grzegorz Braun allegedly prevented a gynaecologist from leaving her office and carrying out her professional duties, constituting a deprivation of liberty. He also allegedly violated the bodily integrity of the gynaecologist by pushing and restraining her with his hands during and in connection with the performance of her professional duties at the hospital. Furthermore, he allegedly insulted and publicly humiliated her, notably comparing her to a Nazi criminal, behaviour that could undermine the public trust necessary for her to practice medicine.
- On 18 March 2025, in front of No 4 Market Square in Opole, Grzegorz Braun allegedly damaged 10 posters placed on five metal frames by applying black paint to form the words STOP PROPAGANDA OF PERVERSION, causing losses totalling PLN 5 327.19 to the Rainbow Opole Association.
- On 14 December 2023, Grzegorz Braun allegedly publicly incited, via the internet, hatred on grounds of religious differences and the commission of the offences of interfering with a religious ceremony and of offending religious feelings, by giving a social media interview about, among other things, the alleged use of a fire extinguisher in the Polish Sejm (parliament) to extinguish the candles of a Hanukkah menorah. He reportedly described Hanukkah as a "satanic and racist" celebration that poses a threat to Polish Catholics.
Grzegorz Braun was elected to the European Parliament in the European elections of June 2024. He was, therefore, a Member of the European Parliament at the time of the alleged offences of 16 April 2025 and 18 March 2025. He was not a Member of the European Parliament at the time of the alleged offence of 14 December 2023.
Parliament considers that the alleged offences do not relate to an opinion expressed or a vote cast by Grzegorz Braun in the exercise of his official duties within the meaning of Article 8 of Protocol No. 7 on the privileges and immunities of the European Union. Furthermore, it has found no evidence to suggest that the legal proceedings in question were initiated with the intention of harming the Members political activities in his capacity as a Member of the European Parliament.
Parliament considers that the alleged offences do not constitute, and the subsequent request for the waiver of the immunity of Grzegorz Braun is not related to, an opinion expressed or a vote cast by Grzegorz Braun in the performance of his duties within the meaning of Article 8 of Protocol No 7 on the Privileges and Immunities of the European Union. Furthermore, it has found no evidence to suggest that the legal proceedings in question were initiated with the intention of harming the Member's political activities in his capacity as a Member of the European Parliament.
