Request for the waiver of immunity of Grzegorz Braun
The European Parliament decided to waive the immunity of Grzegorz Braun.
By letter dated 4 September 2025, the Prosecutor General of Poland transmitted a request from the Kraków Branch of the Institute of National Remembrance, Commission for the Prosecution of Crimes against the Polish Nation (Oddział Instytutu Pamięci Narodowej w Krakowie - Komisja Ścigania Zbrodni przeciwko Narodowi Polskiemu), for the waiver of the immunity of Grzegorz Braun, Member of the European Parliament elected in Poland, in connection with several alleged offences that occurred in 2025.
According to the Parliament report, these alleged offences concern:
- during both a radio interview and a podcast, Grzegorz Braun publicly and contrary to the facts denied the crimes of genocide committed between 1941 and 1944 by officers of Germanys Third Reich in the concentration and extermination camp KL AuschwitzBirkenau in Auschwitz.
The alleged action constitutes an offence under Article 55 of the Act of 18 December 1998 on the Institute of National Remembrance Commission for the Prosecution of Crimes against the Polish Nation.
Grzegorz Braun was elected to the European Parliament in the European elections of June 2024 and therefore was a Member of the European Parliament at the time of the alleged offences.
Parliament considers that the alleged offence does not constitute an opinion or vote cast by Grzegorz Braun in the exercise of his official duties within the meaning of Article 8 of Protocol No. 7 on the privileges and immunities of the European Union. Furthermore, it found no evidence to suggest that the intention underlying the legal proceedings in question is to undermine Grzegorz Brauns political activity as a Member of the European Parliament.
