Combating crime: prevention of crime, criminal offences and terrorism, retention of data processed on public communications networks. Framework Decision. Initiative France, Ireland, Sweden and United Kingdom

2004/0813(CNS)

The committee adopted the report by Alexander Nuno ALVARO (ALDE, DE) rejecting the initiative under the consultation procedure.

MEPs disagreed with the choice of the legal basis and expressed doubts about the proportionality of the proposed measures and the proposal's compatibility with Article 8 of the European Convention on Human Rights. They therefore called on the four Member States concerned to withdraw their initiative. The committee added that a study should be carried out into the need for the proposed data retention arrangements and said that the data retention obligation, the definition of the data to be retained and the retention period should be dealt with separately from the other aspects of the proposal as the subject of a directive.
