PURPOSE: to amend Council Regulation 104/2000/EC on the common organisation of the markets in fishery and aquaculture products.
LEGISLATIVE ACT: Council Regulation 1759/2006/EC amending Regulation 104/2000/EC on the common organisation of the markets in fishery and aquaculture products.
CONTENT: a new Regulation setting up the European Agricultural Guarantee Fund (EAGF) was approved in 2005. (Regulation 1290/2005/EC. For a summary see: CNS/2004/0164.) The new Regulation replaces the 1999 Regulation on the financing of the common agricultural policy, to which certain aspects of Council Regulation 104/2000/EC on the common organisation of the markets in fishery and aquaculture products applied.
The purpose of this Regulation is to bring financial expenditure for fishery and aquaculture products in line with the new, 2005, EAGF Regulation. In summary, therefore, this Regulation amends Regulation 104/2000/EC by stating that:
- Expenditure incurred by the Member States under the terms of Regulation 104/2000/EC will be deemed to be expenditure referred to in provisions set out in the EAGF Regulation (1290/2005/EC).
- Financing will be granted to products from a stock or group of stocks only up to the limit of any quantities allocated to the Member State in question from the total volume of allowable catches for the stock or group of stocks in question.
APPLY: 16 October 2006.
ENTRY INTO FORCE: 2 December 2006.
